No immediate TRO for Mayor Binay from CA this time
The Court of Appeals has held in abeyance its action on Makati Mayor Jejomar Erwin “Junjun” Binay bid to stop the preventive suspension imposed against him by the Office of the Ombudsman.
In a two page resolution, the Court of Appeals instead ordered the Office of the Ombudsman and the Department of Interior and Local Government (DILG) to comment on Binay’s petition within 10 days.
“Action on the application for TRO/Writ of Preliminary Injunction is held in abeyance pending receipt of the parties’ pleadings. Upon submission of the aforesaid pleadings or the application of the period for filing the same the Petition will be deemed submitted for decision,” the appeals court said.
On Tuesday, Binay sought the help of the CA amid the suspension order imposed by the Ombudsman against him over the allegedly illegal procurement of the Makati City Science High School. The DILG served the suspension order at the entrance of the city hall even as Binay’s supporters and the police got entangled in a violent encounter.
