MANILA, Philippines -- The Supreme Court has not acted on the petition of former agriculture undersecretary Jocelyn ?Joc Joc? Bolante to stop the arrest order issued against him by the Senate, according to a radio report.

Radio dzMM said that the justices, including Chief Justice Reynato Puno, were on recess.

In a live radio interview, lawyer Harry Roque said the high tribunal?s non-issuance of a temporary restraining order (TRO) was in itself a decision by the high court.

Bolante, whose arrival from the US is expected late Tuesday night, filed the petition through his lawyer Antonio Zulueta.
