Deficient Information: Prosecutor ordered to clarify tax liability of Jeane Napoles

MANILA, Philippines–The Court of Tax Appeals (CTA) on Tuesday said the Information (charge sheet) against Jeane Catherine Napoles is deficient for failure to specify the exact amount of her tax liability.

In a ruling made public Tuesday, the CTA pointed out that in the amount of “P17,461,038 more or less” referring to the tax deficiency of the younger Napoles, the phrase “more or less” is not acceptable.

“The phrase ‘more or less’ is an unacceptable qualification of the principal amount of tax involved as it fails to accurately state the amount claimed as basic tax deficiency,” the tax court said.

“The Information is deficient with regard to this aspect,” the tax court added.

It ordered government prosecutors to clarify the amount. They were given 10 days upon receipt of the court’s notice to make the clarification.

Meanwhile, the CTA deferred action on Napoles’ motion for judicial determination of probable cause and urgent motion to defer the issuance of warrant of arrest and to suspend proceedings until the government prosecutors’ clarification.
