MANILA, Philippines—The sole evidence against Dalia Guerrero for allegedly conspiring to kill her husband, international car racing champion Enzo Pastor, is inadmissible, her lawyer said on Thursday.
Based on the affidavit of Police Officer 2 Edgar Angel, he was hired by businessman Domingo “Sandy” de Guzman to kill Pastor for constantly beating his wife Guerrero.
Angel said he met De Guzman and Guerrero a day before Pastor was killed.
The Department of Justice (DOJ) resolution that approved the filing of parricide case against Guerrero and murder for De Guzman said it was De Guzman who provided the means to kill Pastor while Guerrero supplied the information.
However, Angel, in his counter-affidavit submitted on Sept. 8, 2014, disowned his confession, saying it was just a “script” written by the police.
“It is the sole evidence that is going to be used against my client but there is still a remedy. We will file a motion for reconsideration. Hopefully they will see the light,” said lawyer Rui Rondain.
“Doon lang nakatayo ang kaso nila on that single affidavit, which is inadmissible,” Rondain told reporters.
On the statement of housemaid Chona Domen that Guerrero and De Guzman is having an illicit relationship, which can be considered a motive, Rondain said it had no connection to murder.
“Even if they have a relationship, it is not enough to constitute a conspiracy,” Rondain said.
The DOJ has already filed the case against Guerrero and De Guzman before the Quezon City Regional Trial Court.
