The Sandiganbayan has junked the plea of former Quezon City administrator Aldrin Cuña to quash the graft charge against him involving the P25-million solar power installation and computerization projects.
Along with former Quezon City Mayor Herbert Bautista, Cuña was accused of complicity in the awarding of a contract and the release of P25.3 billion payment to Cygnet Energy and Power Asia Inc. Cuña argued that his role was merely ministerial and his signing of a “preparatory document for the release of the payment” did not prove corruption.
The anticorruption court’s Third Division cited the lack of merit in Cuña’s argument that “the facts charged in the information against him allegedly do not constitute an offense,” since that is best established in a trial.
The resolution was signed by all division members, Sandiganbayan Presiding Justice Amparo Cabotaje-Tang and Justices Bernelito Fernandez and Ronald Moreno. —DEMPSEY REYES
