MANILA, Philippines?Former Senators Franklin Drilon and Sergio Osmeña III should be disqualified from the 2010 elections as they have not completed the six-year interval mandated by the 1987 Constitution before seeking reelection, said a lawyer who asked the poll body to cancel their certificates of candidacy.
In two separate motions filed with the Commission on Elections on Friday, lawyer Vladimir Cabigao said the two candidates, who are running under the Liberal Party banner, should be disqualified from the race because they have ?not completed the prohibitory of period of one term, or six years? from their last term in 2007.
Drilon, the former Senate president, and Osmeña, did not run in the 2007 mid-term elections as the Charter prevents them from serving more than two consecutive terms, which add up to 12 years. Osmeña is running as an independent in the 2010 polls, but the LP adopted him as a candidate.
Cabigao said the two ex-senators can only seek another term in the 2013 elections after they shall have completed the ?six years or one term interval to comply with the constitutional mandate that no Senator shall serve for more than two consecutive terms.?
Pending the resolution of the petition, Cabigao asked the Comelec to exclude Drilon and Osmeña from the ballot.
