Ebarle lawyer no objection to transfer of Ivler to NBI jail

MANILA, Philippines?A lawyer of the Ebarle family on Thursday said he poses no objection to the plan to transfer road rage suspect Jason Ivler to the National Bureau of Investigation provided Ivler?s stay at the NBI is only temporary.

In an interview with reporters at the Quezon City Hall of Justice, lawyer Romeo Alcantara said he sees no problem with Ivler?s transfer to an NBI detention cell as asked by the Department of Justice.

?For the moment, we are in favor of that if the accused needs medical care for his healing wounds. But that must be a temporary setup only,? said the private prosecutor.

Judge Alexander Balut of Quezon City Regional Trial Court Branch 76 was supposed to hear Thursday morning the DOJ?s motion to have Ivler transferred to the NBI after his discharge from the Quirino Memorial Medical Center in Quezon City.

The hearing was however reset to Friday, court staff said.

The DOJ earlier asked Balut to commit Ivler, who is charged with the murder of Renato Ebarle Jr. in November 2009, to the NBI as the bureau could provide Ivler with medical attention if needed.

?The NBI has a provision for wound care, as they have a clinic with a doctor and nurse, where accused can be committed,? said the omnibus motion signed by state prosecutor Ma. Cristina Villoroza et al.

The DOJ pointed out that his wounds require only routine regular wound care that could be done on an out patient basis, as assessed by Dr Enrico Ragasa of the National Kidney and Transplant Institute.

Sought for comment on Thursday, Alcantara said the NBI would have the medical facilities should Ivler require attention for his wounds sustained in a shootout in Jan 2010.

?It should be a temporary setup only. Once his wounds heal, we will push for his transfer to the Quezon City Jail as earlier ordered by the court,? the private prosecutor said.

Ivler is charged for allegedly shooting to death Ebarle, son of Malacañang Undersecretary Renato Ebarle Sr. on Nov. 18, 2009 in an alleged road rage incident in Quezon City. He was arrested on Jan. 18, 2010 after a shootout with NBI agents at his mother?s house.

The road rage suspect sustained two gunshot wounds and has been confined at the QMMC ever since.

Earlier, Balut ordered that Ivler be detained at the Quezon City Jail after the NBI asked the court to commit him to the Bureau of Jail Management and Penology?s custody.
