New raps filed vs Duque, Garin over Dengvaxia mess

The father of the teenager who died of complications related to the Dengvaxia vaccine in Caloocan City in November 2017 has filed charges against former health secretaries Francisco Duque and Janette Garin and 35 others.

This is the second complaint against Duque and the sixth against Garin. Duque is also facing a separate complaint for obstruction of justice.

The victim’s father, Darwin Bataan said he only learned that his son, Jansyn, 13, was inoculated with Dengvaxia on Nov. 29, 2017 after he arrived home from work. He said they were never informed that there would be an anti-dengue vaccination in their area.

“Napakasakit po ang mawalan ng anak (It hurts losing a child),” Darwin told reporters.

Represented by the Public Attorneys’ Office (PAO), Bataan filed the complaint for reckless imprudence resulting in homicide under Article 365 of the Revised Penal Code and violation of Republic Act No. 9745 (Anti-Torture Act) against the former officials of the Department of Health (DOH).

The PAO filed the charges after its forensic teams established that the deaths of six children, including Jansyn Bataan, could be attributed to the vaccine.

Garin earlier said the complaints filed against her has no basis while Duque questioned why he was included in the PAO’s complaint.
