The Bureau of Internal Revenue (BIR) on Thursday filed criminal complaints before the Department of Justice (DOJ) against a retail plants and flower décor company.
Charged with willful failure to pay taxes under the National Internal Revenue Code of 1997 was Jin Hung Bijoung Art Inc. and its corporate officer, President Anavette Guevarra.
Jin Hung was charged for unpaid tax liability deficiency for taxable year 2011 with a total amount of P9.42 million, inclusive of increments, comprised of: P8.64 million Income Tax and Improperly Accumulated Earnings Tax – P855,379.60
Records of BIR Manila showed that Jin Jung was served with the corresponding Letter Notices (LN), Letters of Authority (LoA), Requests for Presentation of Records, Subpoena Deuces Tecum (SDT), Preliminary Assessment Notices (PAN), Final Assessment Notices (FAN) and Formal Letters of Demand (FLD) with Details of Discrepancies. However, Jin Hung failed to pay or protest the assessments, thus making the assessments final, executory and demandable.
At a press conference, BIR added that Jin Hung ignored the other issuance that it has issued reminding them of its tax liability.
“The respondents’ obstinate failure and continued refusal to pay their long overdue deficiency taxes, despite repeated demands, constitute willful failure to pay the taxes due to the government,” the BIR said at a press conference.
