Syjuco’s bid to reverse decision declaring him nuisance candidate dismissed

The Supreme Court has dismissed the bid of former Iloilo Representative Augusto “Boboy” Syjuco to reverse the decision of the Commission on Elections (Comelec) declaring him as a nuisance candidate in upcoming presidential elections in May.

“The Court dismissed the petitions for certiorari, prohibition and/or mandamus with applications for restraining order and/or injunction directed against various resolutions and/or decisions of the Comelec en banc and/or its First or Second Divisions cancelling petitioners’ respective Certificates of Candidacy (COC) for President on the ground of his being nuisance candidates for the reason that the Comelec did not act with grave abuse of discretion in so holding,” high court’s Information Chief Atty. Theodore Te said.

Last Dec. 3, the Comelec canceled Syjuco’s COC after finding the petition to declare him a nuisance candidate “meritorious.”

The Comelec added that Syjuco also failed to present clear proof of his financial capability, campaign plan or political machinery to sustain a nationwide campaign.

Afterward, Syjuco appealed the decision and elevated the case to the high court saying the poll body erred in disqualifying him from the presidential race as he is well-qualified to run for the highest position in the country.

Furthermore, he argued that the Comelec violated his constitutional right to due process when it ruled against him without the benefit of a hearing.

Meanwhile, Te said the high court also dismissed the bid of several party-list groups to reverse their disqualification ruling by the Comelec.

Dismissed are petitions of United Towards Organic Development Inc. (UTOD), Bantay Laban sa Kriminalidad (BALAK), Ang Kaliwat Partylist, Koalisyon at Aksyon Nag-iimpok para sa Ekonomiya at Gabay ng mga Organisasyon ng Sambayanang May Yamang Oras [1-KANEGOSYO] and the Kapisanan ng mga Netizens sa Filipinas.
