SEN. GRACE Poe’s camp wants the Commission on Elections (Comelec) law department to defer its decision on the election offense case filed by vice presidential aspirant Rizalito David over her citizenship.
The case was submitted for resolution yesterday, after Poe’s camp submitted her counter-affidavit following the 10-day extension granted to them by the Comelec earlier this month.
According to lawyer Manuel Luna, counsel for David, the preliminary investigation yesterday was “deemed terminated” and the case is now submitted for resolution.
“Both counsels jointly manifested that the case is now submitted for resolution by the law department of the Commission on Elections,” Luna told reporters after the proceedings.
Citing Comelec rules, Luna said a decision on the case can be expected in the next 15 to 30 days.
However, Poe’s lawyer George Garcia explained that the electoral offense case should be deferred as there is another pending case of material misrepresentation against his client before the Senate Electoral Tribunal.
