Tabunok vendors bring case to CA

VENDORS who opposed the closure of the Talisay City Public Market yesterday sought the intervention of the Court of Appeals on a ruling that allowed the Talisay City government to pursue its plan to close the old market and opened a new one in barangay Lagtang.

In an interview, their lawyer Junjie Manda said they want the appellate court to “take a second look” at the ruling of Regional Trial Court Judge Douglas Marigomen of Branch 5 who denied the petition for the issuance of a preliminary injunction filed by market vendors.

“We just want to expand our legal arguments,” Manda told reporters.

In his resolution, Marigomen said Talisay City Mayor Socrates Fernandez and the city officials complied with the requirements of the law to effect the closure and transfer of the public market.

The court said a resolution regarding the issue has been approved by the Sangguniang Panglungsod and that a public hearing regarding the transfer of the market was made. Reporter Ador Vincent S. Mayol
