DOLE reminds employers of pay rules for Labor Day

MANILA, Philippines — The Department of Labor and Employment (DOLE) on Friday reminded employers in the private sector to observe the mandated wages on Labor Day, May 1, a regular holiday.

In an advisory issued by DOLE Secretary Silvestre Bello III, he said employees who worked on the said day should be paid double their daily wage for the first eight hours.

“For work done in excess of eight hours (overtime work), he/she shall be paid an additional 30 percent of his/her hourly rate on said day,” Bello said in his advisory.

Meanwhile, employees who work on a regular holiday that also falls on his or her rest day should be paid an additional 30% of his or her “basic wage of 200%.”

“For work done in excess of eight hours (overtime work) during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his/her hourly rate on said day,” the advisory read.

Meanwhile, those who will not report for work on Labor Day should still be paid 100 percent of their salary for that day.

Establishments that have “totally closed or ceased operation” during the community quarantine period amid the pandemic are exempted from the payment of the holiday pay, the advisory added.
