Dacera case: No toxicology report yet from police

MANILA, Philippines — Makati police again failed to submit the toxicology report related to the death of flight attendant Christine Dacera, two lawyers from different camps said Wednesday.

In an ambush interview with reporters, the lawyers said police submitted all medical documents but without the toxicology report. The report was supposed to determine whether Dacera was under the influence of narcotics during the New Year’s Day party.

“May kulang pa. On record naman iyon.  Kulang na lang iyong toxicology report. Hopefully, masasagot ang katanungan sa toxicology report,” Attorney Jose Ledda III of the Dacera camp pointed out when asked about the police requirements submitted to the city prosecutor.

(There are still missing documents. It is on record. Toxicology is still pending. Hopefully, the toxicology report will answer all our questions.)

“They [Makati police] have not yet submitted toxicology results,” said Atty. Mike Santiago, lawyer of respondents facing provisional complaint of rape with homicide over the death of Dacera.

Santiago did not reveal the contents of the documents provided by the police.

However, he said their camp will submit a supplemental affidavit to respond to the materials submitted to the prosecutor’s office.

“The documents will speak for themselves so we will not make conclusions on this yet. We will not overstep the power of prosecutor in this case,” Santiago said.

“There will be another setting on February 3, at 10 o clock for respondents to submit their counter-affidavit, of which, we have already done on the part of the five respondents. But we will submit a supplemental affidavit on their behalf,” he added.

Santiago is the legal counsel of respondents Rommel Galido, JP Dela Serna, Gregorio De Guzman, Clark Rapinan, and Valentine Rosales, who were with Dacera during the tragic New Year’s Day event.

The Makati City prosecutor’s office required the police investigators to submit additional evidence to prove the law enforcer’s claim that Dacera was raped and murdered.

Police are required to submit a DNA analysis report, toxicology/chemical analysis, and the histopath examination report.

The first hearing on preliminary investigation for the Dacera case was held last Jan. 13. It was reset this Wednesday because police are still awaiting the results of the medical documents.
