MANILA, Philippines – A day after the Philippine National Police gave eight of the 11 suspects in the death of flight attendant Christine Dacera 72 hours to surrender, the Makati City Prosecutors Office said evidence submitted by the police to support its complaint is insufficient, the resolution from the Makati Prosecutors Office stated.
“At this point, the pieces of evidence so far submitted are insufficient to establish that she was sexually assaulted or raped. And, if sexual assault/rape was committed, who is/are the person/s responsible,” read the resolution made public Wednesday.
The prosecutors said the evidence is also insufficient to prove how Dacera has died.
“No evidence medically or scientifically was presented to prove that the cause of death or the rupture of the aortic aneurysm was by reason of the alleged rape. Likewise, if the homicide was committed, the person/s responsible is/are yet to be ascertained through further evidence,” the resolution further stated.
It added that there is also no evidence submitted to show that the suspects have conspired to kill Dacera.
The prosecutors said the police had not submitted the DNA analysis results, toxicology/chemical analysis, and histopath examination.
What was established based on evidence submitted?
Based on the evidence submitted, the prosecutor said what was established is only the timeline of what time the suspects and Dacera have checked in, what time their party started, what Dacera drank, and what time she was last seen alive.
The police evidence also established what time Dacera was discovered unconscious, what hospital she was taken, and the cause of death based on the death certificate issued by the Makati Medical Center.
For a case that the police said is already closed, the prosecutor’s resolution stated that :
“After a thorough examination of the evidence presented on the inquest, this Office finds that there are certain matters that need to be clarified to determine the participation and culpability of each respondent for the alleged rape and killing of Christine Angelica Dacera.” [ac]
