MANILA, Philippines–The Quezon City Regional Trial Court has refused to dismiss the illegal possession of firearms and ammunition case against Reynaldo Parojinog Jr., son of slain Ozamiz City mayor Reynaldo Sr.

In a 12-page order, the court said the evidence presented by the prosecution is enough “to sustain conviction.”

“Presentation of countervailing evidence therefore is indispensable,” the court said in dismissing Parojinog Jr.’s demurrer to evidence.

A demurrer to evidence is in effect a motion to dismiss filed by the accused after the prosecution finished its presentation of evidence. The demurrer is anchored on the ground that the evidence presented by the prosecution is insufficient.

With the dismissal of the demurrer to evidence, Quezon City Regional Trial Court Branch 105 acting Presiding Judge Editha G. Mina-Aguba ordered Parojinog Jr. to begin presenting his evidence to counter the allegations of the prosecution.

Reception of evidence will be on March 6, then on 27 and April 17.

The hearings will be at the New Bilibid Prison in Muntinlupa because the accused is already serving life imprisonment for possession of 116,9578 grams of shabu.
