Olongapo court refuses to stop arrest order vs Dennis Sytin

MANILA, Philippines — The Olongapo Regional Trial Court (RTC) has refused to suspend the implementation of the warrants of arrest issued against Alan Dennis Sytin who is accused of masterminding the death of his brother Dominic.

In a two-page order issued Wednesday, Olongapo RTC Branch 72 Judge Richard Paradeza has denied the motion to quash or suspend implementation of warrants for his arrest.

A motion to quash is filed by an accused before arraignment. He challenges Information or charge sheet for defects apparent at face value.

In the case of Sytin, his counsel told the court that there is “no evidence at all” to warrant a probable cause finding to order his arrest.

The motion added that the complainant’s evidence itself cast “grave and serious doubt” on whether or not Edgardo Luib was actually the gunman who shot and killed Dominic last Nov. 28, 2018.

The same motion added that there is no need to place Dennis under custody because “his acts and conduct since the start of the investigation into Dominic’s killing to date negate any attempt to frustrate the ends of justice.”

The court said the issues raised in the motion should best be threshed out in a full-blown trial.

The court added that it is not Dennis’ demeanor that it took into consideration when it issued the warrant for his arrest but the evidence presented by the prosecution.

Dennis Sytin and co-accused Ryan D. Rementilla alias Oliver Fuentes remains at large and have yet to be arraigned by the court.

On the other hand, Luib, the self-confessed gunman has been convicted and meted the penalty of up to 40 years imprisonment.
