DOLE reiterates proper salary payment for employees in December holidays

MANILA, Philippines — The Department of Labor and Employment (DOLE) reiterated to employers the proper payment of wage for workers during special or non-working and regular holidays in December this year.

In a Labor Advisory No. 19 signed by Labor Secretary Silvestre Bello III last Dec. 5, DOLE reminded employers to follow the rules for workers’ salary.

Here are the rules for workers’ salary during special non-working days on Dec. 8, 24 and 31:

Employers must follow the “no work, no pay principle” unless there is an existing company policy or collective bargaining agreement on offering payment on a special holiday.

For work payment during the special holiday, they will be paid an “additional 30 percent of their basic wage on the first eight hours of work.” [(daily rate x 130%) + [ (Cost of Living Allowance) COLA].

For overtime pay, they will be paid an “additional 30 percent of their hourly rate on the said day.” [hourly rate of the basic daily wage x 130% x 130% x number of hours worked].

For their salary during their rest day, they will be paid an “additional 50 percent of their basic wage on the first eight hours of work.” [(daily rate x 150%) + COLA].

For their overtime pay during their rest day, they will be paid an “additional 30 percent for their hourly rate on the said day.” Hourly rate of the basic daily wage x 150% x 130% x number of hours worked].

For worker’s salary during regular holidays on Dec. 25 and 30, the DOLE reminded the following guidelines:

If the employees did not work, they will be paid 100 percent of their salary [(daily rate x cost of living allowance) x 100%]

For work done during the regular holiday. the employees must be paid 200 percent of their wage for that day on the first eight hours [(daily rate x COLA) x 200%].

For overtime pay, employees should get an additional 30 percent of their hourly rate. [Hourly rate of the basic daily wage x 200% x 130% x number of hours worked].

For work done during their rest day, they will be paid an additional 30 percent of their basic wage of 200 percent [(daily rate x COLA) x 200%] + [30% (daily rate x 200%)].
