Philippine National Police (PNP) Chief Director General Oscar Albayalde clarified on Thursday that no case has been filed against former Bureau of Customs (BOC) intelligence officer Jimmy Guban.
According to Albayalde, any complaint that Guban may face for his alleged involvement in the smuggling of P6.8 billion worth of illegal drugs will be for the Department of Justice (DOJ) to decide following recommendations from the Senate.
“Wala pa, it will depend on the recommendation of the Senate blue ribbon (committee) chaired by Senator (Richard) Gordon,” Albayalde, who is in Boracay for the PNP’s presentation of its security capabilities.

The PNP chief added that Gordon told him on Wednesday that he will finish his report for the DOJ to act on the issue.
‘Yon ang sinabi niya, sabi niya kahapon, gagawin niya na ‘yong report niya, and if submitted, it would be up to the DOJ kung talagang i-issuehan siya (Guban) ng warrant or not,” he added.

In a speech in Malacañang, President Rodrigo Duterte ordered the arrest of Guban, after he was linked to the smuggling of shabu hidden inside magnetic lifters through the Manila International Container Port.
“Tell me who is this guy asking for money, extortion. I will call him here, I’ll have him arrested, kaya iyang si Guban pinapa-aresto ko,” Duterte said.
After the President gave the order, PNP has also requested the Senate for the custody of Guban.

Philippine Drug Enforcement Agency (PDEA) Director General Aaron Aquino previously reported that their agents also found magnetic lifters in a warehouse in Cavite.
According to him, drug -sniffing dogs found traces of shabu inside the lifters, which came from China and Taiwan. /muf
