MANILA, Philippines--Stressing that there was no basis for the revocation of his medical license, controversial cosmetic surgeon Dr. Hayden Kho Jr. has filed another appeal before the Professional Regulation Commission (PRC).
?There was no offense committed. If there was, it?s not in connection with the exercise of his profession,? Kho?s lawyer, Lorna Kapunan, told the Inquirer. ?We maintain that there is no ground to revoke his license.?
The PRC Board of Medicine earlier denied for lack of merit a motion filed by Kho seeking the reversal of its previous decision to permanently strip him of his medical license for ?committing immorality as well as dishonorable and unethical conduct.?
?They (Kho?s camp) filed last week a notice and memorandum of appeal with our office questioning the board?s earlier decision as well as its denial of their motion for reconsideration,? said Pharson Mamalo, head of the PRC legal division.
?They were claiming that there were errors committed by the board in promulgating the decision,? he said, adding that Kho?s appeal would be taken up.
Should the PRC again deny Kho?s latest appeal, he may elevate his case to the Court of Appeals or the Supreme Court, Mamalo added.
Kho earlier argued that the board did not observe due process when it decided on his case. He also claimed that the issues discussed in the board?s decision were not taken up during the pre-trial.
The board, however, denied his arguments in its order dated Feb. 8.
?All the issues resolved in the decision were necessarily included in the issues posed in the pre-trial order dated July 10, 2009. Respondent was given an opportunity to answer all the issues in the decision,? it said.
The petition to revoke Kho?s medical license was based on a complaint filed by actress Katrina Halili who had accused him of videotaping their sexual encounters without her knowledge and consent.
The videos, including some showing Kho in intimate situations with other women, were later uploaded on the Internet.
Halili had said in her petition before the PRC that she wanted to prevent the doctor from preying on other women who could be his patients.
Kho was suspended in September for one year by the Philippine Medical Association ?for conduct offensive to the profession.?
He is also facing a malpractice suit which was likewise filed by Halili. In addition, the National Bureau of Investigation has charged him with sexual violence for videotaping his intimate encounters with the actress.
The case is still pending before the Department of Justice.
