MANILA, Philippines--The Board of Medicine of the Professional Regulation Commission (PRC) has denied for lack of merit cosmetic surgeon Dr. Hayden Kho Jr.?s motion seeking the reversal of its earlier decision to permanently strip him of his medical license for ?committing immorality as well as dishonorable and unethical conduct.?
However, Pharson Mamalo, head of the PRC legal division, said it was not clear if the board?s decision was already final or if Kho could still file another motion for reconsideration.
?But once the decision becomes final and executory, his license will be permanently revoked,? Mamalo told Inquirer.
In his motion for consideration, Kho said the board did not observe due process when it decided on his case. He also claimed that the issues discussed in the board?s decision were not taken up during the pre-trial.
The board, however, denied his arguments in its order dated Feb. 8.
?All the issues resolved in the decision were necessarily included in the issues posed in the pre-trial order dated July 10, 2009. Respondent was given an opportunity to answer all the issues in the decision,? it said.
The petition to revoke Kho?s medical license was based on a complaint filed by actress Katrina Halili who had accused him of videotaping their sexual encounters without her knowledge and consent.
The videos, including some showing Kho in intimate situations with other women, were later uploaded on the Internet.
?We are thankful that the PRC immediately resolved and denied the dilatory motion for reconsideration filed by [Kho]. It is only right for PRC not to allow [Kho] to practice his medical profession. Miss Halili will continue to pursue the criminal case she filed against Hayden until he is sent to jail,? Halili?s lawyer, Raymund Palad, said.
Halili had said in her petition before the PRC that she wanted to prevent the doctor from preying on other women who could be his patients.
This is the second adverse ruling against Kho who was suspended in September for one year by the Philippine Medical Association ?for conduct offensive to the profession.?
He is also facing a malpractice suit which was likewise filed by Halili. In addition, the National Bureau of Investigation has charged him with sexual violence for videotaping his intimate encounters with the actress.
Sought for comment, Kho?s lawyer, Irene Garcia, said she has yet to receive copy of the PRC decision.
?We haven?t gotten any news about that, we have yet to see the copy of the decision so I cannot make any comment for now,? Garcia told the Inquirer.
