PRC finds Kho guilty of immorality

Doctor may lose license unless he files appeal

MANILA, Philippines—Controversial cosmetic surgeon Dr. Hayden Kho Jr. may be permanently stripped of his license to practice medicine after the Professional Regulation Commission (PRC) Monday found him guilty of “committing immorality as well as dishonorable and unethical conduct.”

In an interview, PRC legal and investigation division chief Pharson Mamalo told the Philippine Daily Inquirer that the commission had ruled that Kho’s act of videotaping his sexual encounter with actress Katrina Halili—without her consent and knowledge—was immoral, dishonorable, and unethical in the practice of medicine.

Mamalo said the PRC’s finding could result in the permanent revocation of Kho’s medical license.

He added, however, that Kho could still file an appeal. “He still has 15 days to file a motion for reconsideration,” Mamalo told the Inquirer.

However, while his appeal is pending before the agency, Kho cannot practice medicine, he said.

Asked if there was a chance that the PRC could overturn its ruling, Mamalo replied, “It depends [on what his arguments would be], if there were factual errors committed by the commission in deciding the case. Maybe then his case would be reconsidered.”

The petition to revoke Kho’s license was based on a complaint filed by Halili who accused him of videotaping their sexual encounters without her knowledge and consent.

The videos, including some showing Kho in intimate situations with other women, were later uploaded into the Internet.

Halili said in her petition before the PRC that she wanted to prevent the doctor from preying on other women, who could be his patients.

This is the second adverse ruling against Kho who was suspended on Sept. 2 for one year by the Philippine Medical Association “for conduct offensive to the profession.”

He is also facing a malpractice suit against PRC which was likewise filed by Halili. In addition, the National Bureau of Investigation has charged him with sexual violence for videotaping his intimate encounters with the actress.

The case, however, remains pending before the Department of Justice which has formed a panel of prosecutors to study the charges.

Sought for comment, Irene Garcia, Kho’s lawyer, told the Inquirer that her client would appeal the PRC’s decision, saying the agency had decided unfairly on the fate of the doctor’s practice.

“The PRC did not take into account the fact that Kho was not involved in the dissemination of the video and this case [was based on that]. There is no evidence linking him to that.” she said.

According to Garcia, Kho was only slightly bothered by the decision since he had voluntarily stopped practicing medicine when the controversy broke out earlier this year.
