MANILA, Philippines?The Board of Medicine of the Professional Regulation Commission (PRC) denied for lack of merit the appeal of cosmetic surgeon Hayden Kho Jr. to have his medical license back.
The PRC earlier stripped him of his medical license after it found him guilty of "committing immorality as well as dishonorable and unethical conduct." Videos of his sexual trysts with two actresses and a model circulated on the Internet and he admitted in a Senate hearing that he recorded the trysts on video without the consent of his partners. He, however, denied uploading the videos into cyberspace.
In his motion for consideration, Kho claimed that he was denied due process and that the issues discussed in the decision were not taken up during the pre-trial.
But in its two-page Feb. 8 order, the Board claimed that Kho's arguments in his motion were already passed upon in the decision it rendered on Nov. 20, 2009.
"All the issues resolved in the decision were necessarily included in the issues posed in the pre-trial order dated 10 July 2009," the Board said in its Order. "Respondent was given an opportunity to answer all the issues in the decision..."
The Board added that Kho's admission of the use of Ecstasy was no longer and never an issue but only tended to aggravate the penalty imposed on him as discussed in the decision.
The petition to revoke Kho's license was based on a complaint filed by actress Katrina Halili who accused him of videotaping their sexual encounters without her knowledge and consent.
"We are thankful that the PRC immediately resolved and denied the dilatory motion for reconsideration filed by Hayden. It is only right for PRC not to allow Hayden to practice medical profession. Ms Halili will continue to pursue the criminal case she filed against Hayden until he is sent to jail," said Halili's lawyer, Raymund Palad.
Halili said in her petition before the PRC that she wanted to prevent the doctor from preying on other women, who could be his patients.
This is the second adverse ruling against Kho who was suspended on Sept. 2 for one year by the Philippine Medical Association "for conduct offensive to the profession."
He is also facing a malpractice suit against PRC, which was likewise filed by Halili. In addition, the National Bureau of Investigation has charged him with sexual violence for videotaping his intimate encounters with the actress.
