Poe’s camp asks Comelec to dismiss poll offense suit

The camp of Sen. Grace Poe on Friday asked the Commission on Elections (Comelec) to dismiss the election offense case filed by 2013 defeated senatorial candidate Rizalito David due to the Senate Electoral Tribunal ruling.

Poe’s counsel, George Garcia, filed before the Comelec law department a motion to take judicial notice of the Senate Electoral Tribunal (SET) resolution, which affirmed its Nov. 17 ruling that Poe is a natural-born Filipino.

The motion prayed that the Comelec law department dismiss the election offense case due to lack of probable cause.

“All told, given the SET decision and resolution…respondent submits that this Honorable Commission can no longer find sufficient ground to engender a well-founded belief that respondent lied in her COC when she represented that she possessed the citizenship and residency qualifications as senator. The complaint must therefore be dismissed for lack of probable cause,” part of Poe’s motion read.
