CA halts eviction of Ver’s partner

The Court of Appeals has temporarily stopped the eviction from a North Forbes Park mansion of Gen. Fabian Ver’s longtime partner.

In a Feb. 27 ruling released only Wednesday, the appellate court’s special 11th division issued a 60-day temporary restraining order on the Feb. 10 decision of a Makati judge ordering Edna Camcam evicted from a house in North Forbes, Makati City.

At the same time, the court required Camcam to post a P10 million cash bond as it asked the respondent, Dr. Daniel Vazquez, to comment on the petition for review filed by Camcam within 10 days.

It also required Camcam and Vazquez to notify it of any other cases or proceedings involving them as well as issues pending in any court, including the Court of Appeals, “within five days from knowledge.”

In issuing the TRO, the court through Associate Justice Nina G. Antonio-Valenzuela said there was an “extreme urgency (to do so) … and that it appears that grave injustice and irreparable injury would result to petitioner before the matter could be heard on notice.”

The Makati Regional Trial Court Branch 66 last month ordered Camcam to vacate the mansion which had been lent to her rent-free by Vazquez since 1994. This was after it declared Vasquez the rightful owner of the house on Cambridge Circle, North Forbes.

Vasquez said he lent the house to Camcam upon the request of Ver, the former Armed Forces chief, who died in 1998.

The Makati court had also ordered Camcam to pay Vazquez P250,000 a month from the time she received the demand letter in January 2012 up to the time she would actually leave the property.

Camcam used to own the house until she failed to pay a loan to the United Coconut Planters Bank which seized the property. The bank then sold the house to Benjamin Bitanga who later sold it to Vazquez.
