BOC seizes chainsaw misdeclared as personal effects; turns it over to DENR

MANILA, Philippines — The Bureau of Customs (BOC) has confiscated a chainsaw that was misdeclared as personal effects and turned it over to the Department of Environment and Natural Resources (DENR).

The BOC-Port of Batangas on Tuesday said one unit of Husqvarna Chainsaw was turned over to the DENR on July 11.

The shipment came from France and arrived at the Port of Batangas last June 22, and was declared as personal effects, the BOC said in a statement.

Upon physical examination, however, the shipment contained a chainsaw, which does not have the necessary permits from the DENR.

The BOC said a Warrant of Seizure and Detention was issued against the shipment in violation of the Customs Modernization and Tariff Act and in relation to Republic Act 9175, also known as the “Chain Saw Act of 2002”.

“The same was forfeited due to claimant’s failure to overcome the burden of proof during the forfeiture proceedings,” the bureau said.
