THE camp of Senator Ferdinand “Bongbong” Marcos Jr. will file a complaint against Smartmatic project director Marlon Garcia for their “unauthorized change” in the script of the transparency server of the Commission on Elections.
Rep. Jonathan dela Cruz, Marcos’ campaign adviser, said they will file the case on Friday at the Comelec office in Intramuros for the alleged violation of the Section 28 of RA 9369 of Automation Election System Law.
The law prohibits acts that include “interfering with, impeding, absconding for purpose of gain, preventing the installation or use of computer counting devices and the processing, storage, generation and transmission of election results data or information.”
Earlier in the day, Marcos slammed the cancellation of the Senate hearing on the incident supposedly scheduled on Thursday. The hearing was canceled after Smartmatic, the technology provider of the Comelec for the May 9 elections, backed out on the last minute.
On Wednesday, the Marcos camp filed a demand to the Comelec to allow their IT experts to check its transparency servers.
Marcos is in a close fight for the vice presidency against Camarines Sur Rep. Leni Robredo, who is leading the race. His camp claims that after the new script was introduced at the night of the elections, it affected the results of the votes in favor of Robredo.
