GLOBE Asiatique president Delfin S. Lee on Tuesday asked the Supreme Court for the immediate resolution of several cases that questioned the Court of Appeals’ (CA) dismissal of the syndicated estafa case filed against him and the Pampanga Regional Trial Court’s cancellation of his arrest order.
In manifestation and motion filed with the Supreme Court, Lee said the petitions filed by the Department of Justice (DOJ) and the Home Mutual Development Fund (HMDF) should “be dismissed for utter lack of merit and the assailed decisions and resolutions of the various divisions of the CA be affirmed in toto.”
Lee also urged the high court to “directly order the Provincial Warden of the Pampanga Provincial Jail to cause [his] immediate release from detention.”
Lee pointed out that he has been detained at the Pampanga Provincial Jail for almost two years because of an injunction issued by the Supreme Court despite being cleared by the appeals court which also nullified his arrest order.
The appeals court nullified the Information (charge sheet) against him for syndicated estafa.
“The lone Information for Syndicated Estafa in Criminal Case No. 18480 has already been quashed by the Court of Appeals in CA G.R. SP No. 121346… and that such lone Information has not yet been revived by the Honorable Supreme Court,” Lee said.
