Ex-mayor indicted over non-remittance of GSIS, Pag-ibig contributions

The Office of the Ombudsman has brought multiple charges before the Sandiganbayan against the former mayor and treasurer of Sumisip town in Basilan province for failing to remit taxes and social contributions of his employees.

Ombudsman Conchita Carpio Morales ordered Mayor Haber Amin Asarul and treasurer Camlian Borjal charged before the Sandiganbayan with 20 counts of violation of Republic Act No. 8921 or the Government Service Insurance System Act of 1997, 19 counts of violation of Presidential Decree 1752 or the Home Development Mutual Fund Law and 23 counts of violation of National Internal Revenue Code.

It was found that from October 2007 to May 2008, the municipal government did not remit the Government Service Insurance System (GSIS) contributions of its employees while from June 2008 to May 2009, the contributions were belatedly remitted.

Under RA 8921, employers are required to remit GSIS contributions on or before the 10th day of the ensuing month.

Asarul and Borjal also delayed the remittance of their employees’ Pag-ibig contributions from October 2007 to January 2009 and from March to May 2009.

The officials violated PD 1752 which states that employers must remit contributions within 15 days from the date the contributions were collected.

The Ombudsman’s investigation also found that the two officials delayed the remittance of taxes withheld for the period of July 2007 to May 2009.

Morales directed the Commission on Audit-Autonomous Region of Muslim Mindanao to conduct a special audit on the cash accounts of the town from July 2007 to July 2009 to see if any anomalous practices have ensued. CDG
