4 charged for bullets found in their baggage ordered released

The Pasay City Prosecutors Office has ordered the release for further investigation of four individuals charged for bullets allegedly found in their baggage at the Ninoy Aquino International Airport (Naia).

In four separate resolutions approved by City Prosecutor Nolasco Fernandez Jr., ordered release were Rufina Cruz, Mildred Bitog, Ma. Josephine Rabano, and Shine Enola.

“After a review of the evidence during inquest, the [prosecutor] finds no probable cause to charge the respondent for illegal possession of ammunition,” the resolution stated.

Under Republic Act 10591 or the Comprehensive Firearms and Ammunition Regulation Act, to determine if the bullet recovered from the respondents is an ammunition, there is a need to subject it to a ballistic examination.

“The evidence submitted during inquest lacks such a finding or certification from the proper government agency which is vital to determine if respondent violated the firearms and ammunitions law,” the resolution stated.

“In view of such lacking piece of evidence, there is a need to subject the case for further investigation in a preliminary investigation to determine her culpability, if any,” the resolution further stated. AU
