CA creates special division to tackle Junjun Binay’s suspension order
THE Court of Appeals has formed a Special Division of 5 to resolve the question on the validity of the second preventive suspension order against Makati Mayor Jejomar Erwin “Junjun” Binay in connection with the anomalies surrounding the construction of the Makati Science High School Building.
Appeals Court 9th division created a special division of 5 after the three justice members of the division failed to come up with a unanimous vote on the case. The action is pursuant to the internal rules of the Court of Appeals.
After a special raffle was conducted, Associate Justices Franchito Diamante and Socorro Inting were added to the division originally composed of Associate Justice Melchor Sadang, the ponente, and Associate Justices Amy Lazaro-Javier and Rodil Zalameda.
Binay was preventively suspended for six months over the alleged rigging of the bidding for the construction of the 10-story Makati Science High School building.
