SC baffled by OSG client’s memo

Curiously, the client “changed the theory” of her counsel.

The Supreme Court has asked the Office of Solicitor General (OSG) to comment on the memorandum that the OSG’s client, Ombudsman Conchita Carpio Morales, had filed as a summary of arguments in her petition against Makati Mayor Jejomar “Junjun” Binay’s plea against his preventive suspension.

The high court ordered the OSG to file a comment on Morales’ memorandum which she “signed by herself even as the OSG has entered its appearance as counsel for the Ombudsman.”

The high court noted that Morales’ memorandum had changed a critical argument, questioning the overall jurisdiction of the appellate court over Binay’s certiorari plea.

“The Ombudsman has changed the theory previously raised during oral arguments and in the pleadings by the OSG,” the high court said in a summary of the resolution released on Tuesday.
