Pay Rallos P44M, city told
IT’S final and official.
The Cebu City government has to pay at least P44 million to the Rallos family whose lot in Banilad Estate was expropriated in 1963 for a road project.
In Sept. 23, 2011, order, Judge James Stewart Ramon Himalaloan of the Regional Trial Court Branch 9 gave the go signal for the sheriff to issue a writ of execution against the city government.
The city government owes P44,213,000 as just compensation with interest of 12 percent per annum computed from Sept. 2, 2001, until fully paid.
The city earlier paid a partial amount of P56.1 million to the Rallos family, which includes P100,000 in litigation fees.
If the city government can’t immediately pay the amount, it has to choose any of its properties, said the court. The writ of execution was approved by Jeoffrey Joaquino, overall Clerk of Court in Cebu City.
