BIR files tax case vs another Malampaya contractor

MANILA, Philippines—The Bureau of Internal Revenue (BIR) on Thursday filed before the Department of Justice a tax evasion complaint with the Department of Justice (DOJ) against another contractor of one of the projects funded by the Malampaya funds.

Facing complaint for willful attempt to evade or defeat tax for taxable years 2008, 2009 and 2010 and deliberate failure to supply correct and accurate information in his annual income tax return for 2008 and willful failure to file annual income tax return for 2009 and 2010 and willful failure to file value added tax returns for 2008 to 2010 is Agerico Banzon, sole proprietor of Banz Built Construction.

Banzon’s company was engaged by the Provincial Government of Palawan to construct several infrastructure projects funded by Malampaya funds from 2008 to 2010.

Documents showed that Banzon underdeclared his gross receipts by P17.51 million or 6,262.25 percent in 2008 by declaring in his ITR a measly-sum of P279,646.00 as gross revenues. He likewise failed to file his ITRs for taxable years 2009 and 2010 as well as his VAT returns for the entire years of 2008, 2009 and 2010 and thus, failed to declare the corresponding income / gross revenues for the said years.

He was assessed with a tax liability of P62.46 million.
