A CEBU City court dismissed the complaint for drunk driving filed against the barangay captain of Sirao.
The charge against Felix Limotan was dropped for lack of evidence.
Limotan was driving his Mitsubishi Adventure along Leon Kilat Street on Oct. 24, 2008, when he hit a taxi.
He later reached an amicable settlement with the driver but the Cebu City Traffic Operations Management (Citom) still filed the case against him for violation of the Traffic Code of the Philippines.
During the trial, Dr. Eduardo Camalongay of the Cebu City Medical Center testified that the barangay captain was found positive for alcohol intake.
But since Limotan was not made to undergo a Romberg’s sign testing, the doctor said, “We cannot conclude that the patient has taken alcohol.”
Judge Oscar Andrino of Branch 5 of the Municipal Trial Court in Cities dismissed the complaint.
Limotan’s lawyer was Cebu City Councilor Sisinio Andales.
Andales said no impropriety was involved since he was not yet a city official when the case was filed in 2008./CHIEF OF REPORTER DORIS C. BONGCAC
