A 69-year-old former security guard was shot dead by his nephew while he was gathering firewood in barangay Guinsay, Danao City, northern Cebu.
Venancio Avila was shot in the chest. He died while being brought to the hospital.
The suspect, Danilo Batulan, 35, son of Avila’s sister, surrendered to the police after the incident.
PO2 John Bensi, desk officer of Danao police, said it was possible that the suspect waited for the victim and attacked him.
Police recovered a .38 caliber revolver with three bullets and two empty shells for a .38 revolver from the crime scene.
Batulan claimed he acted in self-defense when he shot his uncle.
The suspect alleged that it was his uncle who tried to attack him while he was gathering firewood around 8 a.m. yesterday.
In a phone interview, the suspect told Cebu Daily News that his uncle shot him but missed.
Batuhan said they grappled for the gun.
The suspect said he overpowered his uncle and shot him using the gun that his uncle allegedly used to shoot him.
Police said that prior to the incident, the victim and the suspect had an argument where the suspect was punched by his uncle who threatened to kill him if he did not pay his debt.
Batulan said his uncle got irked when he told him he did not know anything about the debt he was talking about.
Police said Batulan is detained at Danao police station pending the filing of charges against him.
