Retired Supreme Court Chief Justice and 2002 Ramon Magsaysay awardee Hilario Davide Jr. will speak on “Revisiting the Trust Doctrine of Intergenerational Responsibility: Impacts of the Trail-blazing Oposa Ruling” on Feb. 9 at 2 p.m. at the audio-visual room of University of Cebu-Banilad campus in Banilad, Cebu City.
Davide penned the widely-admired case of Oposa vs. Factoran, promulgated in July 30, 1993, in which the Supreme Court held that 43 petitioner-minors, duly represented by their parents, have the personality to sue in behalf of the succeeding generations, “based on the concept of intergenerational responsibility insofar as the right to a balanced and healthful ecology is concerned.” The ruling has inspired stakeholders and children from various parts of the world to take action against government agencies for inaction or infraction of environmental laws which impairs the people’s rights to a healthful and balanced ecology.
The lecture will be attended by students from the different universities and colleges, lawyers, members of the judiciary, local government officials and representatives from both the public and private sectors.
As part of the year-long celebration of the 10th Year Anniversary of the UC College of Law, and in its continuous pursuit of providing legal service and instilling public awareness on stirring issues, the UC College of Law, through the UC Law Students Society (UCLASS), hosts the lecture under the continuing UCLASS Lecture Series: Learning from the Experts program. The UCLASS lecture series aims to enhance the knowledge of the students and citizens on the Law from experts and luminaries in the bench and the bar.
