Motion for bail
The Korean businessman who is on trial for allegedly kidnapping another Korean and a Filipina has asked the court to release him from jail.
Song Sung Heum, through his lawyer Michael Maestrado, filed with the Regional Trial Court a manifestation and urgent motion for bail.
While Song was charged with a non-bailable offense, he may be granted temporary liberty pending trial if the evidence of guilt against him is not strong.
Maestrado said their motion for bail should be heard immediately by the court.
RTC Judge Ma. Lynna Adviento of branch 58 earlier denied the same pleading filed by the accused since it wasn’t served to the Prosecution three days before the date of the hearing—a mandatory procedure under the Ruels of Civil Procedure.
Maestrado nonetheless filed another motion for bail yesterday./Reporter Ador Mayol
