Hayden wins anew vs Katrina

The Court of Appeals has affirmed a 2010 ruling of the Pasig City Regional Trial Court dismissing the case filed by actress Katrina Halili against former celebrity doctor Hayden Kho over their sex video scandal.

Halili had accused Kho of violating the law on violence against women and children when he allegedly uploaded on the Internet videos of their sexual trysts. Halili also claimed she was unaware that Kho had them recorded.

In December 2010, Judge Rodolfo Bonifacio of Pasig RTC Branch 59 granted Kho’s motion to have the case dismissed for lack of evidence. The local court also denied Halili’s motion for reconsideration the following year.

In a ruling released Thursday, the CA court’s second division upheld the Pasig RTC decisions.

In a decision penned by Associate Justice Manuel Barrios, the court said the earlier grant of Kho’s motion to dismiss or demurrer on the basis of the case having no sufficient evidence was equivalent to an acquittal and thus cannot be appealed. Christine O. Avendaño
