Capitol board dismisses case vs D’bantayan mayor

THE Cebu Provincial Board dismissed for lack of evidence the administrative case filed by  Provincial Treasurer Roy Salubre againt Daanbantayan Mayor Ma. Lusi Loot.

The case stemmed from the town’s failure to  remit to the province its real estate tax collections.

The committee said  the function of remitting to the province its share in  taxes is the duty  of the municipal treasurer under the Local Government Code.

It also noted that the provincial treasurer failed to establish evidence to confirm that the municipal treasurer of Daanbantayan was told by Mayor Loot not to remit the share of the province and  that she refused to sign the checks.

There was no statement taken from the municipal treasurer as proof.

Loot was charged with grave misconduct, dereliction of duty and abuse of authority, all thrown out for lack of  sufficient evidence.

Hearsay evidence is not enough and “mere allegation is not evidence,” the resolution stated.

This is the second administrative charge that the PB dismissed against Mayor Loot.

The other one involved Loot’s closure order against illegal cemeteries in her town.
