CEBU City Mayor Michael Rama is asking the City Council to already adopt a Regional Trial Court ruling which says that Rosalina Village is within the territorial jurisdiction of barangay Guadalupe.
Rama said that the council should use the RTC ruling in resolving the pending boundary dispute between the neighboring barangays of Guadalupe and Labangon.
In an en banc ruling last May 29, the Commission on Election has already scheduled a July 28 plebiscite to create a new barangay Banawa-Englis from Guadalupe.
Rama said he will vote “yes” in the upcoming plebiscite.
Although already living in the Rama Compound in barangay Basak San Nicolas, he continues to be a registered voter of barangay Guadalupe where he used to live.
Republic Act 9905 approved in January 2010 sponsored by former congressman Antonio Cuenco seeks to split barangay Guadalupe into two barangays.
The Comelec made the decision after Cebu City south district election officer Edwin Cadungog informed them that the RTC had denied a petition filed by now Labangon barangay captain Victor Buendia for lack of merit.
Buendia asked the RTC to stop the plebiscite on May 13, 2010 because of fear that the creation of the new barangay will disqualify him from seeking elective post in barangay Labangon.
Comelec Commissioners decided during their May 29 en banc meeting if yes votes prevail in the plebiscite, residents who live along B. Rodriguez St. to the corner of Happy Valley Subdivision up to Rosalina Subdivision will already be made part of the new barangay of Banawa-Englis. /Doris C. Bongcac, Chief of Reporters
