Manila Jockey Club security officer accused of rape

A Pasig City prosecutor has ordered the filing of a rape charge against a security officer of a racing club based on an accusation made by his co-worker.

In a three-page resolution released recently, Pasig Assistant Prosecutor Nonito Tagalicud made the recommendation after he found probable cause in the complaint against Manila Jockey Club security officer Michael Angelo Rearte.

According to the alleged victim, Rearte’s co-worker, the rape occurred on Dec. 5, 2011, after their office Christmas party.

Based on her complaint, a copy of which was provided to the Inquirer, the alleged victim said that she and her friends decided to have more drinks at Eastwood City Mall in Quezon City right after the office party at the Manila Jockey Club.

When she decided to go home, she said she took a taxi but she was surprised because someone else boarded the vehicle right after she did.

Due to her drunkenness, she passed out, she added.

She recalled that when she woke up, she was inside a motel room in Pasig City being abused by the defendant.

“The complainant said she resisted but felt helpless in stopping the respondent,” the prosecutor said.

In his defense, the accused denied the rape although he admitted that he took the alleged victim to a motel but with her consent.

He added that during the party, the complainant had flirted with him.

The prosecutor, however, found his denial “a weak defense over positive identification.”

The case was raffled off last week to Branch 71 of the Pasig Regional Trial Court, which has yet to issue a warrant of arrest against the accused.
