MANILA, Philippines — The Land Transportation Office-National Capital Region (LTO-NCR) has issued a show-cause order against both the driver and the owner of a sports utility vehicle (SUV) involved in a road crash incident in Mandaluyong City.
According to the LTO-NCR in a statement on Tuesday, the driver’s licenses of both individuals have also been suspended for 90 days.
The road crash incident, which went viral online, occurred at around 1:45 a.m. on December 23, 2023, along Edsa corner United Street, Barangay Highway Hills, Mandaluyong City.
In the show-cause order issued by Regional Director Roque Verzosa III, both the owner and the driver of the Mitsubishi Montero were required to explain why they should not be held liable for the violations of traffic laws:
• Section 48 (Reckless Driving) of R.A. 4136 in relation to Rule I-e (Reckless Driving) of JAO No. 2014-01
• Section 27 (a) (Improper Person to Operate a Motor Vehicle) of R.A. 4136
• Rule II (a) (Driving an Unregistered Motor Vehicle) of JAO No. 2014-01
• Section 55 (Duty of driver in case of accident) of R.A. 4136
Moreover, the LTO said the vehicle was unregistered at the time of the incident.
Both the owner and the driver were instructed to appear before the LTO-NCR Regional Office on January 4, 2024, with a notarized affidavit explaining why they should not be held liable for the four mentioned violations.
Failure to appear and submit a notarized affidavit, along with other supporting documents, will be considered a waiver to contest and address the allegations, thereby authorizing their office to administratively resolve the case based on the existing records, said the LTO.
According to an incident report from the Philippine National Police Mandaluyong Station 2, the driver of the Mitsubishi Montero stalled the vehicle in the fast lane of Edsa and was observed sleeping inside.
Upon knocking on the vehicle door, the driver woke up, accelerated swiftly, ran over a certain Raina Frances Cada, and immediately fled the scene at high speed.
The driver is already facing charges of reckless imprudence resulting in physical injury and violation of Republic Act 10586 or the Anti-Drunk and Drugged Driving Act of 2013.
