Ouster of Legazpi Mayor Rosal final – Comelec

MANILA, Philippines — The Commission on Elections (Comelec) on Wednesday declared the disqualification of Carmen Rosal as mayor of Legazpi City is final.

This comes following the issuance of an order of execution, which recognizes the certainty of the decision.

“The Comelec Rules of Procedure provides that decisions or resolutions of the Commission en banc become final and executory after five days from receipt unless restrained by the Supreme Court,” said poll body said in a statement.

“With no restraining order having been issued by the Supreme Court to date, the same has become final and executory with the issuance of the Certificate of Finality and will be entered in the Book of Entries of Judgment,” it added.

Comelec en banc previously affirmed the disqualification of Rosal in a decision dated May 4, 2023, proclaiming second-placer Alfredo Garbin Jr. as the Mayor of Legazpi City.

Rosal was earlier charged with violation of Section 68(a) of the Omnibus Election Code, which pertained to giving of money to voters during the 2022 national and local election.

The clerk of Comelec will now issue a directive so that government agencies like the Department of Interior and Local Government can implement the resolution.

Comelec chairperson George Garcia said the writ would be released on Thursday.
