Prosecutors are claiming that a gun recovered from Marlene Aguilar’s house when her son, road rage suspect Jason Ivler, shot it out with lawmen was the same one used in the shooting of the son of a former Malacañang official in 2009.
Assistant Chief State Prosecutor Richard Anthony Fadullon asked a Quezon City court to summon Ronan Masacupan of the Firearms Investigation Division in Camp Crame, who conducted tests on the cal. 45 pistol seized from Aguilar’s home in 2010, to appear in court.
“The police were able to recover slugs from the body of the victim, Renato Ebarle Jr. The National Bureau of Investigation (NBI) stepped in and also recovered slugs from his vehicle,” Fadullon told reporters after a hearing on Friday.
He said that after Ivler’s shoot-out with NBI agents, authorities were able to recover a cal. 45 handgun in Aguilar’s house.
According to Fadullon, the slugs that the NBI got from the vehicle matched the gun seized from the Aguilar house.
The court set the next hearing for April 27 after an NBI agent failed to show up and testify against Ivler.
Apart from Masacupan, also set to testify for the prosecution is NBI special agent Emmanuel Lapus, who was among those who joined the raid on Aguilar’s house that led to the arrest of the accused.
Ivler is facing a murder charge for allegedly shooting Ebarle in a road rage incident along Santolan Road on the night of Nov. 19.
Ebarle was on a Toyota Land Cruiser while Ivler rode a Honda CRV with a diplomatic plate eventually traced to his stepfather, Stephen Pollard, during the incident.
Ivler was eventually arrested after he was wounded in a gun battle with NBI agents at his mother’s house on Jan. 19, 2010.
The suspect is now detained at the Special Intensive Care Unit of the Bureau of Jail Management and Penology in Camp Bagong Diwa, Taguig City.
