CALAMBA barangay captain Victor Quijano yesterday said he would exhaust all legal remedies to stop his political rival Ester Concha from unseating him as the duly elected captain in the last October 2010 elections.
Quijano’s reaction came after the Municipal Trial Court in cities Branch1 Judge Monalila Tecson declared Concha as the winner in last year’s barangay captain race.
This was in contrast to last year’s results where Quijano was declared winner with a lead of 81 votes.
Concha filed a protest and asked for a recount.
The court declared Concha the winner garnering 2,539 votes while Quijano got 2,500 votes.
Concha, who was also a former captain of Calamba, assured to file a motion for a writ of execution of the order so she can assume the post.
But Quijano said Concha could not yet assume the post because the order was not yet final and executory.
Quijano said complained that the judge did not listen to their complaint about how the protested ballots were preserved by the city treasurer’s office.
Quijano said the ballot boxes, which were placed at the parking area at City Hall and got wet during a flood.
These resulted in some of the contested ballots under his name not to be counted.
Quijano said he will be meeting with his lawyers to discuss his next legal action./Correspondent Jhunnex Napallacan
