THE case involving the sale of the South Road Properties (SRP) is back in Cebu City.
The Court of Appeals (CA) in Manila won’t handle the case filed by barangay Tinago councilor Joel Garganera that questioned Cebu City’s ownership of the SRP.
The appellate court in Manila claimed that the case couldn’t just be transferred without an order from the Supreme Court, said Associate Justice Gabriel Ingles of Cebu City’s appellate court.
This means that the CA Cebu City station has to handle the case despite Garganera’s doubts on the partiality of the justices after the city government allocated a portion of the SRP for a CA building.
The case was raffled to CA’s 19th division.
Ingles chose to inhibit from the case citing the CA Cebu City station being a beneficiary of the donation of Rep. Tomas Osmeña (Cebu City South district).
Osmeña is a respondent-appellee in the case. /Reporter ADOR VINCENT S. MAYOL
