The Court of Appeals (CA) has ordered outspoken Duterte critic Sen. Antonio Trillanes IV to answer the petition of the Department of Justice (DOJ) seeking his arrest and trial for coup d’etat over the 2003 Oakwood mutiny.
The DOJ has appealed the decision of the Makati Regional Trial Court (RTC) Branch 148 last October not to revive the opposition senator’s criminal case, despite President Rodrigo Duterte’s proclamation nullifying the 2010 amnesty given to rebel soldiers, mainly Trillanes.
The CA’s Seventh Division gave Trillanes 10 days to reply to the DOJ petition to overturn the decision of Makati RTC Branch 148 Judge Andres Soriano.
The division is composed of Associate Justices Sesinando Villon, Edwin Sorongon and Germano Legaspi.
In August 2018, the President issued Proclamation No. 572 that voided the amnesty granted to Trillanes.
