A Makati court on Tuesday ordered the camp of Senator Antonio Trillanes IV to file their comment opposition on the motion of the Department of Justice’ (DOJ) to partially reconsider the court’s ruling denying the government’s bid to arrest the senator.
“The latter (Trillanes) has 15 days from October 25, 2018 within which to file a comment/opposition to the Motion for Partial Reconsideration, copy furnished by personal service the State Prosecutors who are given a period of five days from receipt of the comment/opposition to file a reply to the same,” the order of Judge Andres Soriano of the Makati City Regional Trial Court (RTC) Branch 148, read.
After the pleadings are filed, the DOJ’s appeal will be submitted for resolution.
The Makati RTC Branch 148 earlier denied a request by the DOJ to issue an arrest warrant against Trillanes for coup d’ etat in connection with the 2003 Oakwood Mutiny.
But Judge Soriano, in a 33-page ruling, affirmed the validity of President Rodrigo Duterte’s Proclamation 572 revoking Trillanes’ amnesty granted by former President Benigno Aquino III in 2010.
