MANILA, Philippines—The Solicitor General asked the Supreme Court to dismiss all pending cases in connection with American marine Daniel Smith, who was acquitted of raping a Filipina in April.
In a two-page manifestation, Solicitor-General Agnes Devanadera said there was no more legal issues that the high court could tackle after the Court of Appeals acquitted Smith.
“The US Embassy announced that Lance Corporal Smith departed the Philippines under the authority of the United States military officials. That said, there is no more justiciable controversy for this Honorable Court to resolve because the acquittal and subsequent release of Lance Corporal Smith renders the issue of his custody moot,” Devanadera said.
The Court of Appeals last month acquitted Smith saying what transpired between him and a Filipina, identified in court only as Nicole, was a “spontaneous romantic episode,” not rape.
The cases pending before Supreme Court include a petition filed by several groups questioning why Smith’s lawyers notarized Nicole’s affidavit, wherein she recanted her allegations of rape.
The high tribunal also has a pending order for Court of Appeals Presiding Justice Conrado Vazquez to investigate the leak of a draft decision, written by retired Associate Justice Agustin Dizon, which acquitted Smith.
